Two news regarding the Transformers 3 Accident.
Reports are coming in that Gabriella Cedillo had to undergo brain surgery on Thursday afternoon. She is now in stable condition. It’s happy to hear that she’s recovering. Hearts of all Transformers Fans are with her… Wishing a full and fast recovery.
Meanwhile, Deadline Hollywood is reporting that Paramount has spoken to them, Nikki Finke writes…
“Paramount just weighed in with me to say that the injured extra was not involved in the stunt, that her car was not involved in the stunt, that a “freak accident caused her injury”, that she and her car were more than 500 feet from the stunt, that she was struck by a flying metal object whose welding had come apart and not by a steel towing cable, that the stunt from Tuesday had to be repeated Wednesday because of a “timing issue” and not because it had failed, and that “nobody has done movies more safely than Michael Bay”. The studio, however, could not explain why its version of events was so at odds with the local police and media reports. “We feel horrible that anyone was injured and will take all appropriate action,” a Paramount exec told me.”
Also, some reports say that the filming of Transformers 3 is halted temporarily, although no official statement was made regarding that.

I won't attest to the quality of the weld in question here as I have not seen it and I am no expert. but the forces in play on this stunt are something that is virtually impossible to predict and there for it difficult at best to prepare for all contingencies.
This was a tragic accident , nothing more.
Paramount should have to pay the woman for her injuries and her ongoing care and expenses. pretty much all the paper OSHA signed off on is good for is protecting them from claims of negligence in the lawsuit.
it could not have been prevented, that said professional stunt people should have been doing the driving in which this woman was involved.

Unforseeable, yup, kindof the nature of accidents isn't it?
The weld did not hold though, so I don't see the point of stating the work was done by a certified welder. That's just a way of saying 'we're not to blame'.
Who did the calculations for the weld? How was it checked? Was NDT carried out and to which standard? Who calculated the forces that'd be excerted on the weld during the stunt?
Given the distance to the extra and the damage it did to her, there would have been some extreme forces involved.
There're no freak accidents, just bad planning, bad precautions and bad assumptions.
Bottom line, IMO they (Paramount) are responsible and they should pay, regardless of what piece of paper they've made the extras sign.

Great news! Glad to know that, as horrible as it was, it wasn't because someone dropped the ball.
I suspect they will. I'd imagine some form of Workers' Compensation. The amount requested in the law suit was very reasonable so I have no doubt that the studio will either meet or beat that in the form of a settlement.

The accident was "unforeseeable" and "The weld was made by a certified welder and all necessary safety precautions were in place." says the court (according to TMZ).

She was driving in the adjacent lane.
At first I thought the bracket was attached to the cable and it whipped back and it crashed into the car. But now I realized that a separate piece of the bracket flew out and that was what caused the incident.

The lawsuit is for excess of 50 000$ for each defendant. Which means that it's at least 350 000$ though the judge might determine more.
The plaintiff's claims are:
Paramount is responsible for the people on set and what happens to them. They also responsible for properly training and safeguarding the extras.
Gabriela Cedillo wasn't made aware of any danger to her.
A stunt car was being pulled by flatbed truck with a cable attached with a bracket to the rear axcle of the car. And it was "crashed" at a speed of more than 50 mph (80 kph) "by a violent pull of cable". It was going in opposite direction with Gabriela's car. She closed in to a distance of 50 feet (15 meters).
The metal welding broke and a piece of the bracket became airborne. It was what hit Gabriela's car.
Paramount "knew or should have known" that that performing the stunt posed a danger to people in a 50 feet radius.
Now what does "crashing the car at a speed in excess of 50 mph by a violent pulling of the cable connection" mean?

pretty much sums it up as to what a majority of folks are saying. thanks for dumbing it down(nice way of course) for the rest of the folks and what not.
people normally do sign waivers. and yes there are different kinds, such as likeness on tv and then stunt and action and possibility of an accident. (imagine bungie jumping or skydiving). I can tell you right now that, no drivers signed waivers for stunts and what not. ( i can't confirm nor deny extras who were on set who were running away from 'monsters')
